Draft Code of Practice on Flexible Working

As outlined in our previous JEL alert, from 6 April 2024, employees will be entitled to make a flexible working request from day one of their employment.

ACAS has recently published a draft Code of Practice on requests for flexible working which is currently awaiting parliamentary approval. The Code aims to clearly explain the law on the right to request flexible working and provide employers with practical advice on handling such requests. The Code addresses:

• The obligation of the employer to consult with the employee in relation to any flexible working request received;
• How a decision should be communicated by the employer;
• The appeal process; and
• Allowing an employee to be accompanied at meetings.

Once approved, the updated Code of Practice is expected to come into effect in April 2024.
