On 31 July 2014 an amendment to the Transfer of Undertakings (Protection of Employment) Regulations 2006 (TUPE) will come into effect.

Employment law news

This amendment will allow employers with ‘fewer than 10 employees’ to directly consult with affected employees where there is no recognised independent trade union and the employer has not invited affected employees to elect appropriate representatives.

It is presumed that this change to the TUPE regulations will reduce some of the administrative burden on small businesses involved in such transfers.
