A further statutory test must be met in order for a service provision change to occur.

The definition of service provision change, which mainly concerns outsourcing situations, is being amended to reflect recent case law. In future, for a service provision change to occur, a further statutory test must be met, namely that the activities performed prior to and following the change in provider must be fundamentally the same.
