In the end of January the government has confirmed that it will proceed with a new legislative provision to make pre-termination negotiations inadmissible in unfair dismissal cases even in the absence of a pre-existing dispute.

This will be done through the introduction of a new statutory code of practice on how to resolve workplace disputes. ACAS will shortly publish a draft statutory code for public consultation, with the final code expected to come into force this summer.
A model settlement agreement and template letters will also be issued to encourage employers to use the new legislative provision.
