Employee liability information will now require to be provided not less than 28 days (as opposed to 14 days) before the relevant transfer, in circumstances where the transfer takes place on or after 1 May 2014.

This will be beneficial to transferees who will receive employee liability information earlier in the process. Transferors should, however, be mindful of the change to ensure that they provide employee liability in advance of the new deadline, to avoid liability (the Employment Tribunal can award compensation that it considers to be just and equitable, subject to a minimum of £500 per employee).
