The right to request flexible working was extended to all employees with 26 weeks’ continuous service or more in June 2014.
An employee can still only make one request in a 12 month period and an employer can still only refuse a request if one or more of eight specified grounds applies. However, the right to request flexible working is no longer limited to employees with particular caring responsibilities and the strict statutory framework in terms of the timescales within which the request must be dealt with have been relaxed. Now, the obligation on the employer is simply to deal with the request in a reasonable manner and to inform the employee of the decision, including any appeal, within three months.
